【連署】 《漂亮朋友》全台上映網路連署與修改電影片原產地國籍認定方式請願 /Petition of commercial release for BEL AMI in Taiwan




2024年金馬獎頒獎典禮結束,獲得包含觀眾票選獎等四個獎項卻無緣「最佳影片」和「最佳導演」的同志題材電影《漂亮朋友》(出品國籍為法國),也沒有順利抽籤取得「大陸電影片」每年在台上映十部的配額資格,因此以金馬影展作為全球首映的《漂亮朋友》,至今僅能以影院特映形式於台北光點華山和高雄內惟藝術中心各放映四場。

原因是台灣行政機關仍以製造業為法規訂定之參照原則,對電影片國籍認定以「同一國籍或地區之主要演員(主角及配角)超過主要演員總人數二分之一之國籍或地區認定之」。

近年來嘗試打開國際合製大門的台灣,卻依然維持著落後定義、甚至有些時候根本是自圓其說的法規,即使國際通行的電影國籍認定方式是以出品/製作公司的稅籍登記之國籍為標準(國際電影資料館聯盟 FIAF 發佈之電影資料保存規範第1.1.1.條款),而不僅是擁有中國演員與拍攝地的外籍電影深受影響,也有台灣創作者製作的電影作品飽受該法規的困擾。

在此除了請您留下支持《漂亮朋友》能於全台商業上映之外,也請支持台灣文化部訂定之「國產與非國產電影片國籍認定基準」應修改為「符合國際通行規則」的訴求,懇請文化部重新審議台灣上映電影片的原產定認定規則,文化藝術類作品產地定義應有別於其他製造業產品,並建議調整大陸地區電影獲得重要獎項可不受限於配額制度的規範,從國際三大影展、美國影藝學院(奧斯卡)競賽單元、金馬獎最佳影片、最佳導演等獎項,擴大範圍至其他得獎獎項亦得不受配額限制。

The Golden Horse Award ceremony 2024 has closed. "Bel Ami," a film with LGBTQ+ theme that was awarded 4 prizes including the Audience Choice Award but missed out on "Best Picture" and "Best Director," which resulted in the film not successfully obtaining one of the ten annual quota for "Mainland Chinese films" to be released commercially in Taiwan. Only one problem: its “country of origin” is actually France. Despite having its world premiere at the Golden Horse Film Festival and wishing to hold its official release in Taiwan, "Bel Ami" has only been able to hold special screenings with four showings each at SPOT Huashan in Taipei city and Neiwei Art Center in Kaohsiung city due to the special act in Taiwan.

The reason stems from Taiwan's administrative agencies continuing to base their regulations on principles more closely related to the manufacturing industry rather than the film industry, identifying a film's country of origin by defining it as "the nationality or region where more than half of the main cast (leading and supporting roles) are from."

While Taiwan has been attempting to open its doors for international co-productions in recent years, it maintains outdated definitions and sometimes self-contradictory regulations. This persists despite the internationally accepted standard for identifying a film's “country of origin” being based on the principle office of the production company (as per Article 1.1.1 of the International Federation of Film Archives' film guidelines – “The FIAF Cataloguing Rules For Film Archives”). This affects not only foreign films with Chinese actors and filming locations in China but also creates difficulties for films made by Taiwanese filmmakers.

In addition to requesting your support for the commercial release of "Bel Ami" in Taiwan, we also would like to ask for your backing of the proposal to amend "Criteria for determining domestic and non-domestic film’s country of origin" of the Ministry of Culture of Taiwan, to align with international standards. We urge the Ministry of Culture to reconsider the rules for identifying a film's “country of origin,” recognizing that cultural and artistic works should be defined differently from other manufacturing products. We also suggest adjusting the exemption of the quota regulations for mainland Chinese films that receive film awards of the official competition at Cannes, Berlinale, Venice, Academy Awards, and Golden Horse Awards for Best Picture and Best Director, expanding beyond the current exemptions to include other award categories as well.
